Please read these terms carefully before using Bright Future Foundation. By accessing our platform, you agree to be bound by these terms.
By accessing or using the Bright Future Foundation platform ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, users, campaign organizers, and donors.
You must be at least 18 years old to make a donation or create a campaign in your own name. By using the Platform, you represent and warrant that you meet this requirement. Individuals under 18 may access the Platform only under the supervision of a parent or legal guardian, and may not independently enter into transactions or create campaigns.
Bright Future Foundation is built to be simple and frictionless. You do not need to create an account, register, or set a password to make a donation. To support a cause, you simply choose a campaign, select a donation amount, and complete a secure checkout — nothing else is required.
Because we do not operate user accounts, logins, or donor dashboards, we recommend keeping the confirmation email and receipt you receive after each donation. Campaign organizers may be asked to verify their identity and the details of their fundraiser before funds are released. Bright Future Foundation reserves the right to request additional information, and to suspend, remove, or restrict access to any campaign or to the Platform in cases of suspected fraud, misuse, or violation of these Terms.
All campaigns created on Bright Future Foundation must comply with our Campaign & Community Guidelines. By creating a campaign, you agree that:
Prohibited campaigns include, but are not limited to: campaigns promoting illegal activities, hate speech, violence, discrimination, or fraudulent purposes. Bright Future Foundation reserves the right to remove any campaign that violates these rules without prior notice. Donations made through Bright Future Foundation are voluntary contributions intended to support the cause described in each campaign. Your donation goes toward the cause you choose to support. Donations are processed securely through our third-party payment processor (see Section 6).
By making a donation, you acknowledge and agree that:
We take donor protection seriously. In cases of duplicate charges, an incorrect amount, payment or technical errors, unauthorized transactions, or confirmed fraud or misuse, we will review your request fairly and may issue a refund. If you ever have a concern about a donation, please contact us first so we can resolve it directly — this is usually the fastest way to make things right and helps avoid unnecessary payment disputes. Full details on eligibility and how to request a review are available in our Refund & Cancellation Policy. If you believe a campaign is fraudulent, please contact us right away.
Donations on the Platform are processed by Stripe, a third-party payment processor, in accordance with Stripe's own terms and privacy policy. When you donate, your payment-card details are collected and processed by Stripe on its own secure systems — Bright Future Foundation does not receive or store your full card number.
When you make a donation, you are donating to Bright Future Foundation. As a nonprofit organization, the Foundation receives donations and directs funds to the campaigns, causes, and programs it supports, in furtherance of its charitable mission. The Foundation retains control and discretion over donated funds and how they are allocated. Before funds are distributed in connection with a campaign, an organizer or beneficiary may be required to verify their identity and eligibility. We may hold, delay, review, reverse, or withhold the release or processing of funds where we reasonably suspect fraud or misuse, a violation of these Terms or our Campaign & Community Guidelines, or where required by law or by our payment processor.
Bright Future Foundation is a nonprofit organization that raises funds to support the causes and campaigns featured on the Platform. Donations are not held on deposit for donors or organizers, and we are not a bank, money transmitter, or escrow service. Because the Foundation directs funds at its discretion, we do not guarantee that any individual campaign will receive, or continue to receive, a specific amount of funds.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Bright Future Foundation and its officers, employees, and agents from and against any claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) any campaign you create, promote, or contribute to; (c) content you submit to the Platform; or (d) your violation of these Terms, our Campaign & Community Guidelines, any applicable law, or the rights of any third party. This applies in particular to campaign organizers with respect to the campaigns they run and the funds they receive.
When using Bright Future Foundation, you agree not to:
All content on the Bright Future Foundation Platform — including logos, text, graphics, and software — is the property of Bright Future Foundation and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
By submitting content (campaign descriptions, photos, etc.) to the Platform, you grant Bright Future Foundation a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Platform.
To the fullest extent permitted by law, Bright Future Foundation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of funds, data, or reputation.
Bright Future Foundation acts as a platform intermediary and is not responsible for the actions, conduct, or representations of campaign organizers or donors.
Bright Future Foundation does not guarantee specific outcomes, timelines, or results related to any charitable initiative, fundraiser, or beneficiary. The Platform is provided on an "as is" and "as available" basis, and your use of it is at your own discretion and risk.
Bright Future Foundation reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Platform will immediately cease.
These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.
Bright Future Foundation reserves the right to update these Terms at any time. We will notify users of significant changes by posting the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
